1. Scope of Application

These General Conditions (GTC) apply to all contracts concluded for the purchase of goods, services or other items (hereinafter referred to as “Goods”) in the online shop at the URL indicated above in the version valid at the time the contract was concluded . These GCS apply exclusively. Different conditions of the customer do not become an integral part of the contract, unless the supplier expressly accepts them.

2. Conclusion of the Contract

2.1 Invitation to Offer

Offers in the online shop represent a non-binding invitation from the supplier to the visitor of the online shop to submit an offer to purchase the goods offered in the shop.

2.2 Ordering Process

The goods are ordered via the supplier's online order form. After selecting the desired product(s), entering all required mandatory data and completing all other mandatory steps of the order process, the selected goods can be ordered by pressing the order button at the bottom of the page of order (order). By placing an order, the Customer makes a binding offer to stipulate a purchase contract for the selected product(s). The contract is concluded when the Supplier accepts the Customer's offer.

3. Right of Withdrawal for Consumers

Consumers generally have the right of withdrawal for contracts concluded away from business premises and for distance contracts. By consumer we mean any natural person who enters into a legal transaction for predominantly non-commercial or self-employed purposes. The details can be found in the cancellation policy, which is provided to each consumer at the latest immediately before the conclusion of the contract.

4. Payment, Default

4.1 Prices and Payment

The prices indicated in the online shop at the time of ordering apply. All prices include the value added tax (VAT) required by law and the shipping costs indicated. The customer will be informed about the payment options available in the supplier's online shop.

4.2 Payment Methods

If an electronic payment method has been agreed upon, payment is due immediately upon conclusion of the contract. If the payment method is "Bank Transfer", the order remains pending until the bank transfer is received. If the bank transfer is not executed after a few days Giardino Carnivoro reserves the right to cancel the order and put the products on sale again.

5. Retention of Title

The goods remain the property of the supplier until the purchase price has been paid in full.

6. Delivery and self-delivery reserve

6.1 Delivery Process

Unless otherwise agreed, delivery will take place to the delivery address indicated by the customer within the delivery period indicated in the online shop. The applicable delivery times shown in the online shop are indicative and may be subject to change in the event of holidays, illness or unexpected events. We reserve the right to ship via express courier to the address indicated by the customer at the time of the purchase order no later than 15 days from the date of receipt by the customer of the purchase order confirmation email sent by Giardino Carnivoro .

7. Warranty

The provisions of legal liability for defects apply.

8. Responsibility

8.1 Unlimited Liability

The Supplier has unlimited liability:

for damages resulting from injury to life, body or health which are based on an intentional or negligent breach of duty by the Supplier or on an intentional or negligent breach of duty by a legal representative or agent deputy of the Supplier;
for damages that are based on an intentional or grossly negligent breach of duty or on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of the Supplier;
on the basis of a guarantee promise, unless otherwise agreed;
on the basis of mandatory liability (for example, under product liability law).
9. Data Protection

The Supplier will treat the personal data of its customers confidentially and in accordance with data protection laws. For further information, please see the Supplier's privacy policy.

10. Final Provisions

10.1 Applicable Law

The law of the Italian Republic applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), provided that this choice of law does not result in a consumer with habitual residence in the EU being deprived of the mandatory legal provisions of the law of your place of residence.

10.2 Competent Court

If the Customer is a trader, a legal entity under public law or a special fund under public law, the court of the registered office of the Supplier will be competent, unless an exclusive forum for the dispute has been established. This applies even if the customer is not domiciled in the European Union. The registered office of our company is indicated in the title of these Conditions.

10.3 Invalid Provisions

Any invalidity or unenforceability of a provision of this contract does not affect the validity of the remaining provisions of the contract.

The Supplier is not willing or obliged to participate in any dispute resolution procedure at a consumer dispute resolution body.
